Three held in murder attempt on American

One week after being ordered by Prime Minister Abhisit Vejjajiva to speed up the case, police have apprehended three suspects they say were involved in the attempted murder of a US national in Hua Hin last year. Yutthana Areesawat, 36, Samart Areesawat, 41 and Ek-anand Jitmahima, 50, were arrested yesterday in the resort district in Prachuap Khiri Khan in connection with the shooting of Donald Whiting. The 65-year-old US national, whose wife is deputy rector of Stamford International University in neighbouring Phetchaburi's Cha-am district, was shot twice in front of his house on the night of Oct 24. Hua Hin police chief Kasana Chamsawang said Mr Whiting had since moved to Bangkok as he needed to continue his medical treatment. Mr Whiting has a bullet lodged in his neck. After the three confessed to attempted murder they were taken to the crime scene for a re-enactment of the crime. Mr Yutthana said he had been hired for 200,000 baht to kill the American by the wife of a foreigner developing a major housing estate in Hua Hin. Police said they needed to gather more evidence before a warrant could be issued for the arrest of the mastermind. Mr Whiting had reportedly criticised the developer over the construction of his house before the local media. He was shot soon after lodging a complaint with local agencies. His car was also set ablaze at his home on July 3. The arrests came after the prime minister last Wednesday ordered deputy national police chief Thanee Somboonsap and assistant police chief Aswin Kwanmuang to double their efforts in cracking four high-profile crime cases, including the shooting of Mr Whiting.
The other three cases involve the murders of four Saudis in 1989 and 1990, the disappearance of human rights lawyer Somchai Neelaphaijit in 2004, and the killing of Kornthep Viriya, alias "Shipping Moo", in 2003.
Pol Gen Thanee yesterday admitted police involvement in the disappearance of Mr Somchai was obstructing the investigation. Police have been unable to recover the body or trace the whereabouts of the lawyer.
On the disappearance of Pol Maj Ngern Thongsuk, a key defendant in the Somchai case, Pol Gen Thanee said it could not be assumed the officer was dead since his body had not been found. Police are still searching for him.
Pol Maj Ngern and a relative, Naruechai Chinwannarat, disappeared in a mudslide on Sept 19, 2008, while they were supervising the construction of a reservoir. Naruechai's body was retrieved but Pol Maj Ngern is unaccounted for.
Pol Gen Thanee was confident the investigation would make some progress due to a change of government.
Mastermind of murder attempted on American arrested

Police on Thursday arrested the mastermind of the attempted murder of a US national in Hua Hin last year when she was about to escape to the neighbouring Cambodia. Junpen Yungyu, 48, wife of a foreigner developing a major housing estate in Hua Hin, was arrested at Aranyaprathet district by immigration police for ordering the murder of Donald Whiting, whose wife is deputy rector of Stamford International University. The arrest came only a week after Prime Minister Abhisit Vejjajiva ordered police to speed up the case. On Tuesday, police apprehended three suspects they said were involved in the attempted murder of Mr Whiting.Janpen Oxley, 48, the Thai wife of British national Darren Oxley, was arrested at 7 am Thursday at Aranyaprathet on the Thai-Cambodian border.
"Janpen asked for an entry stamp to Cambodia but when her name popped up on the computer there was an alert that an arrest warrant had been issued for her," Immigration Police Lieutenant Colonel Benjapol Lortsawat said in a telephone interview from Aranyaprathet, 200 kilometres east of Bangkok.
"She had been waiting at the border checkpoint since 4 am," said Benjapol. "Janpen told immigration officials she wanted to get in to Poipet to help a friend who had lost her money at the casinos." Poipet, Cambodia, is a popular gambling destination for Thais. Janpen is the alleged mastermind behind the attempted murder of Donald Whiting in Hua Hin, a beach resort 130 kilometres south-west of Bangkok, on October 24. Thai police on Tuesday arrested three suspected gunmen in the shooting of Whiting, 65, who was embroiled in two property disputes in Hua Hin, an upmarket beach resort that has become popular among foreign retirees. The three suspects confessed to having been hired by Janpen to kill Whiting for 200,000 baht (5,714 dollars).
Police have also issued an arrest warrant for Oxley, a British national who has invested in several housing developments in Hua Hin. Whiting had bought a house from Oxley but complained he had been overcharged for water supplies. Whiting, an ex-marine who has been living in Hua Hin for the past five years, was involved in a second property dispute with another foreign developer who had been contracted to build a 13.6-million-baht villa in the resort for him and his wife Dolly Samson. The US couple claim that the contractor took their money and left them with an unfinished, sub-standard concrete monstrosity instead of the Thai-Bali style mansion they had dreamed of. Whiting was a frequent contributor to websites dedicated to complaints about property scams at Hua Hin. Whiting's car was set on fire in July 2008, and shortly afterwards he was shot in the neck, leaving him partially paralysed. He was shot a day before a court hearing in which he was scheduled to open a lawsuit against Janpen and her husband. Property scams have been widely reported in Hua Hin, known as the "royal resort," a favourite summer retreat for Thai high society. More recently it has drawn a plethora of world-class hotel chains and posh boutique getaways.
The Whiting case was one of four unsolved crimes that newly appointed Prime Minister Abhisit Vejjajiva last week ordered the national police chief to solve. The other cases include the slaying of four Saudi nationals in 1989 and 1990, the disappearance and suspected murder of human rights lawyer Somchai Neelpaijit in 2004 and the 2003 slaying of Kornthep Viriya, a shipping agent and key witness in a tax evasion case against a company owned by former prime minister Thaksin Shinawatra.
Saudi cases are not easy to solve

The police are commended for their quick solving of Donald Whiting's shooting case. But they will not have an easy task to tackle the three other unsolved cases. The arrest Tuesday of three suspects in the attempted murder of an American national, Donald Whiting, was both welcoming and a surprise. It came less than a week after Prime Minister Abhisit Vejjajiva ordered the police to “revive” the case as well as three other unsolved crime cases. Under the direct responsibility of the deputy national police chief Pol Gen Thanee Somboonsap and his assistant, Pol Lt-Gen Asawin Kwanmuan, the police mananged to nab Yuthana Areesawat, a 36-year old security guard of a real estate company in Prachuab Khiri Khan, at a hideout in Petchaburi province. Two other suspects, Samart Areesawat, Yuthana’s brother, and Ek-anan Chittimahima, were eventually apprehended in Pathum Thani province. Yuthana allegedly admitted that he was hired 200,000 baht by his boss to kill Mr Whiting, husband of the deputy rector of Stamford International University in Cha-am district. Whiting who survived the gun attack reportedly filed complaints to several agencies about the poor construction standards of the house he bought from the real estate company. The arrest of the three suspects represented a blow to Pol Col Krisana Jamsawang, chief of Hua Hin police who had been unable to arrest any suspect since the attack took place on last October 24. It is yet to be seen whether and when the police will be able to nail the mastermind of Whiting’s attempted murder. Although both Pol Gen Thanee and Pol Lt-Gen Asawin deserved credit for the quick solving of Whiting’s case, the three other unsolved crime cases will be a hard nut to crack if they will ever be solved at all. The murder of three Saudi diplomats and the disappearance of a Saudi businessman, Mohammed al Ruwaili, who was believed killed, have dragged on since 1991 through several successive Thai governments each of which promised to “revive” the cases but ended up failing to shed any new light to solve the cases. Last year, justice minister Sompong Amornvivat of the Samak government went to the prison to visit imprisoned Pol Lt-Gen Chalor Kerdthet, to seek the latter’s help to solve the two cases.
Thai police suspected that the murder of the Suadi diplomats and the disappearance of the Saudi businessmen might be connected with the stolen Saudi jewellery case or with alleged corruption in the export of Thai workers to Saudi Arabia. However, the New York Times, in its March 1997 edition, offered another theory that the diplomats might be killed by the Saudi Hizbollah terrorists who were also responsible for the murders of Saudi diplomats in Ankara and in Karachi in 1988. Cynically billed the “seven-generation” cases for the many years that the cases remain unsolved and the resultant embarrassment to successive Thai governments, the successful solving of Donald Whiting’s case cannot be applied to these cases which are more complicated and, moreover, may involve persons in high places. It is a matter of whether rather than when these cases will ever be solved at all?
Last but not least is the murder of human rights lawyer Somchai Nillapaichit. There are two major aspects of the case: one is the whereabouts of Somchai’s remains which may never be located and the other is those responsible for his disappearance and eventual murder. A few junior police officers have been arrested in connection with Somchai’s abduction. Police investigation abruptly ended and the trail went dead, leaving a lot of unanswered questions about those of higher rankings who were also involved in the crime.

The wife of a Briton wanted in Sheffield for drugs dealing has been arrested in Thailand for ordering a ‘hit’ on one of her husband’s clients in Thailand. And police have also issued a warrant of arrest for Darren Oxley, a former Sheffield night club bouncer, over the shooting of an American on an estate he managed in the Thai resort of Hua Hin, 140 miles south of Bangkok.
Janpen Oxley, 48, his Thai wife, was seized today as she tried to cross Thai Cambodian border at Aranyaprathet, 200 miles east of Bangkok. Police said they are still looking for Oxley, who fled bail while awaiting drugs charges at Sheffield Crown Court to become a builder property developer and property manager in Thailand. But they believe he may have successfully crossed the border. Janpen Oxley, had allegedly commissioned the shooting of American Donald Whiting, who had accused Oxley of sending him extortionate water bills on a private estate in the Thai resort of Hua Hin. Whiting’s water was cut off when he complained and Oxley had been summonsed to appear in court in Prachuap Khiri Khan, the provincial capital 200 miles south of Bangkok, the day after the shooting. Whiting, 65, was gunned down outside his retirement home last October. He remains paralysed from the waist down. He is being cared for by his wife Dolly, a University lecturer. Prior to the shooting, he claimed, his car had been firebombed.
Also prior to the shooting the Whitings and Oxley had been involved in a public slagging match on the ‘Monsters and Critics’ website forum. The site administrators had to close the forum because of the insults traded. The Whitings were warned they were ‘in for a slapping’
Oxley is believed to have been furious at the damage done to his business. A former doorman at the Republic Club in Sheffield, Oxley, was arrested in a sting operation carried out by police on May 19th 2001 and subsequently charged with dealing in a Class A drug.
His rise from petty criminal to club bouncer and violent drugs dealer has been compared to that of Carlton Leach, the subject of the 2007 film ‘Rise of the Footsoldier’. Carlton Leach was a football hooligan, who went on to become a club bouncer and major drugs dealer. His gang beat up their rivals and nailed enemies to the floor.
Nine colleagues of Oxley, who were arrested at the same time, were sentenced to a total of sixty years in jail. Oxley jumped bail and fled to Thailand where he bought a Lamborghini and Bentley and Range Rover and went into the property trade, and married the ex-wife of a Thai police officer.
